Terms of Service

1. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at support@funnelandtrace.com of any unauthorized access. We are not liable for losses caused by unauthorized use of your account.

3. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to track, profile, or attribute users without their knowledge or in violation of any applicable privacy law (including GDPR, UK GDPR, and CCPA);
• Use the Service to collect data on websites or pages you do not own or have permission to track;
• Attempt to gain unauthorized access to other users' accounts or data;
• Probe, scan, or test the vulnerability of the Service or attempt to bypass security measures;
• Reverse-engineer, decompile, or attempt to extract source code from the Service except to the extent expressly permitted by applicable law;
• Use the Service to send unsolicited communications or commit any form of fraud or harassment;
• Use the Service in a manner that violates the terms of any third-party platform connected through the Service, including Meta Platforms.

4. Meta (Facebook) Integration

If you choose to connect a Meta advertising account, you authorize us to access ad-account data (spend, performance metrics, campaign structure) via the Meta Marketing API for the sole purpose of displaying that data within your Funnel & Trace dashboard. You agree to comply with Meta's Platform Terms and Developer Policies when using this integration. You can disconnect the integration at any time from the Settings area of the Service, after which we delete your stored Meta access token.

5. Your Content

You retain ownership of all data you submit to the Service, including funnel configurations, lead information, and tracking events captured from your visitors ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to operate the Service for you.

You represent and warrant that you have all necessary rights to submit Your Content to the Service and that doing so does not violate any law or third-party right.

6. Service Availability

We strive to make the Service available with reasonable uptime, but we do not guarantee uninterrupted access. The Service may be unavailable from time to time due to maintenance, infrastructure issues, third-party outages, or events outside our reasonable control. We are not liable for any losses caused by Service downtime.

7. Pricing and Fees

The Service is currently provided free of charge. We reserve the right to introduce paid plans in the future, in which case we will provide reasonable advance notice and you may choose whether to upgrade or terminate your account.

8. Termination

You may stop using the Service and delete your account at any time. See our data deletion instructions for the account-deletion process.

We may suspend or terminate your access if you violate these Terms, if your use of the Service poses a security or legal risk to us or other users, or if required by law. Where reasonable and not prohibited by law, we will notify you in advance.

9. Intellectual Property

All intellectual property in the Service (including software, design, trademarks, and content authored by us) is owned by Silentria LLC or our licensors. Except for the limited rights expressly granted to you under these Terms, no rights are transferred to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY ANALYTICS OR ATTRIBUTION RESULTS PRODUCED BY THE SERVICE WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SILENTRIA LLC, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold Silentria LLC harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you via email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
